Rental contract

The Rental Period: Shall commence on & include date of actual delivery of the Equipment to the Lessee or Lessee's agent, including any public carrier taking same for transit to the Lessee. The rental period shall end on & include the date of actual delivery of the Equipment of the Lessor, another lessee of the Lessor or an agent of either including any public carrier. Calculation of Rental Charges: 4 week & weekly rental rates shall not be subject to any deduction on account of non-working time in the 4 week or week. Daily rental rates shall not be subject to any non-working time in the day and shall be paid for each calendar day. All Rental Rates: Contemplates an operating day of a regular single shift of eight (8) hours, in respect of any operating day which exceeds a single shift of eight (8) hours operation, the rental rate shall be increased for such day by fifty (50%) percent for double shift and 100% for three shift operation. Payments: The rentals due under this lease are payable in advance to the office of the Lessor at the address designated. The rental for the minimum period is payable before delivery of the equip- ment to the Lessee or the latter's agent or carrier. Transportation: The Lessee agrees to pay all transportation charges to the place where the said machinery and or equipment is to be used & returned therefrom. Maintenance, Operation & Repairs: The Lessee shall see that the Equipment is not subjected to careless or needlessly rough usage and shall at the Lessee's own expense, maintain & ultimate- ly return to the Lessor the Equipment & as its appurtenances, together with any tools and accessories pertaining thereto, the whole in good repair & running order. Without limiting the foregoing the Lessee shall, at the Lessee's own expense, pay the cost of al fuel & lubricants required to operate the Equipment, all repairs required to keep it all in good repair & running order, replacement of bro- ken or worn out parts. Liability of Lessee: the Lessee shall indemnify the Lessor against all loss, expenses, penalties, damages condemnations & law costs which the Lessor may suffer or may be required or condemned to pay for personal injuries (including death) and or property damage suffered by any person by reason of the Equipment or the operation, handling, transportation or use thereof or use thereof by or while in the hands of the Lessee or the latter's employees, agents or carriers. Inspection: It is agreed that the lessor makes no warranty or guarantee whatsoever as to the Equipment or it's performance. The Lessor shall have the right at any time to enter upon the premises occupied by the Equipment or it's performance and shall be given free access thereto and afforded all necessary facilities for the purpose of inspecting the equipment. Title: Title to the Equipment shall at all times be & remain vested in the Lessor and nothing contained in this Lease shall be deemed to have the effect of conferring upon the Lessee any right or title whatsoever in or to the Equipment other than that of a Lessee. Insurance: The Lessee agrees to save & hold harmless the Lessor from all claims for loss or damage to the connection therewith. Subletting: None of this Equipment shall be sublet by the Lessee, nor shall he (it) assign or transfer any interest in this Lease without he previous written consent of the Lessor. There are no warranties of merchantability or fitness either expressed or implied which extend beyond the description on the face hereof. 2% PER MONTH CHARGED ON ALL OVERDUE ACCOUNTS.
